In most cases, a bail bonds application can be completed and secured in less than 30 minutes. If property is used, the process will take longer because the value of the property must be verified. Protecting Your Rights

A person's right to post bond and be released from jail prior to their court hearing is a constitutional right guaranteed by the 8th Amendment. That right can be taken away, however, if the crime is severe or the judge feels that the defendant is a threat to themselves or others. The amount of bail assigned to each type of crime is equivalent to the severity of that crime. The more involved, complex or severe a crime is, the higher the person's bond will be. The state requires a non-refundable, non-negotiable, 10% premium be paid to obtain the defendant's release. Once the premium has been paid and the bail bonds application approved, the defendant will be released.

Once out of jail, the defendant must agree to abide by the requirements and guidelines put forth by the court. The defendant must appear at all scheduled court hearings and comply with any specific requests the court may make. This includes turning over any weapons or attending drug and alcohol classes. At any time, if the court discovers that the defendant has not remained in compliance with the court's demands, their bail will be revoked and a warrant will be issued for their arrest. If the defendant fails to appear, the judge will forfeit the defendant's bail and require them to be placed under arrest. The co-signer may also revoke the defendant's bond if they no longer feel that they want to be financially responsible. If the defendant does remain in compliance, attends all of their court dates and does everything the court asks, any money over and above the 10% premium will be returned to the co-signer after the sentencing phase of the case has ended.
